By clicking to send this authorization we, counsel for the Plaintiff,
confirm we have authority to enter into this Commercial Vessel Arrest
Authorization and bind our client, the Plaintiff in the underlying
action, to all of the terms and conditions set forth herein. The
Plaintiff agrees to pay National Liquidators for all services rendered
under this authorization in accordance with National Liquidators'
Commercial Vessel Services and Rate Schedule, a copy of which will
be provided to you upon request. Should National Liquidators be
required to take any action to enforce this agreement and/or collect
any sums due hereunder National Liquidators will be entitled to
recover reasonable attorney's fees and costs associated therewith
plus 1.5% interest per month on any amount not paid within 30 days
of billing. Further, by signing below, we agree to defend and indemnify
G. Robert Toney & Associates Inc., d/b/a National Liquidators
and any approved contractors from any and all expense, loss, damage,
claim or action arising out of its handling of this assignment,
including reasonable costs and attorney's fees, except where such
expense, loss, damage, claim or action is a result of the negligence
of National Liquidators or its approved contractor. National Liquidators
is hereby authorized to take all reasonable measures to protect
and maintain the value of the property seized and to prevent liabilities
to third parties, including personal injury, property or pollution
damage, without further authorization.
